Hi!

We are moving to NM this fall and were thinking about homeschooling our 11-year old. He is my stepson but we have him full-time. Would I be allowed to do this according to NM laws? My husband has a GED but he doesn't have the paperwork and he also has ADD so he lacks the patience and structure to do this himself. Should he be the person "legally" conducting the school anyway?

Hi RR, I believe the law states that the homeschooling teacher must be "parent or legal guardian". I'm not a lawyer, or a member of the state board of education, but I would think that a step parent relationship comes under the heading of legal guardian. It's very unlikely that anyone from the state is going to check up on you, in any case. Good luck!

I know I am not a legal guardian as a step parent so I guess my husband will have to be the one on the paper then?

I put both names on the paper simply because if there is ever an emergency with are both technically listed as teachers.  The state does not ask to see a copy of GED or any other credentials.  You just state your credentials on the form.

I hope you are right. Just worried that the bio-mom will "make" someone take a look, you know...
